Terms & Conditions
 
 
  1. With the acception of Habitat sales (no buyer's premium), buyer agrees to pay for property purchases in full (including all applicable taxes), plus a buyer's premium of 10% for purchases up to and including $50,000 and 5% for purchases in excess, with cash, cashier's check, certified bank check, or personal/company check subject to approved credit. No other method of payment shall be deemed acceptable pursuant to the articles of this agreement. Payment is due in full within twenty-four (24) hours of purchase on auction items priced up to and including $25,000, and within three (3) working days for all other amounts. Manor & Street is authorized by buyer to obtain buyer's credit information.

  2. All articles are sold [AS IS WHERE IS] with no warranties or guarantees of any type either expressed of implied by Manor & Street, LLC, (dba) Manor & Street Auction Specialists, hereinafter called 'Manor & Street.' Any warranties made by the Seller must be in writing on an instrument separate and apart from the Purchase Invoice and or Bill of Sale, and signed by both the Buyer and Seller. Under no circumstance shall Manor & Street, or any employee, agent or associate of Manor & Street be held responsible or liable for any warranties, guarantees, claims, or descriptions of any kind for any article offered for sale.

  3. All statements contained in Manor & Street print catalogues, brochures, space advertisements, signs and lot tags, as well as those verbally acknowledged by the auctioneer or staff, are qualified statements of opinion and not representations or warranties. Neither Manor & Street nor its employees is authorized to make on behalf of the company or the consignor any representation or warranty, whether oral or written, with respect to any property. Any dispute between Buyer and Seller regarding statements of opinion, description or any other conveyance shall in no way affect Buyers obligation to pay for purchase the day of sale.

  4. All statements contained in Manor & Street print catalogues, brochures, space advertisements, signs and lot tags, as well as those verbally acknowledged by the auctioneer or staff, are qualified statements of opinion and not representations or warranties. Neither Manor & Street nor its employees is authorized to make on behalf of the company or the consignor any representation or warranty, whether oral or written, with respect to any property.   5. Any announcements made the day of sale supersede printed information in catalogues, brochures, space advertisements, signs, and or lot tags..

  6. All articles will be removed from the auction venue by the Buyer at his or her expense immediately following the sale. In the event of failure to remove articles from the auction venue following the conclusion of the sale, Buyer agrees to pay ALL removal and storage costs incurred by Manor & Street. Manor & Street reserves the right to withold article(s) until removal and storage costs are paid in full.

  7. Buyer agrees that if there is a breech of any of the terms of sale contained in this document, or any other attachment, that in addition to the standard remedies of law available to Manor & Street and/or the Seller (including the right to hold the buyer liable for the bid price), Manor & Street and/or the Seller at their discretion may choose to exercise either of the following options: (#1) Cancel the sale and retain as liquidated damages all payments made by the Buyer, (#2) Resell the article(s) after five days written notice to the Buyer at a private or public sale as compensation for Buyers breech of contract (sale is conducted at Buyer's risk with Buyer being held liable for any price difference between first and second sale price of article(s), plus costs for resale including moving and storage, fees and commissions for both sales, and all reasonable attorney fees and court costs incurred).

  8. All articles offered for sale are sold without reserve unless otherwise stated. Under the terms of reserve selling, the auctioneer is authorized to bid on the seller's behalf in an amount not to exceed the reserve price.

  9. Ownership of an article passes to the Buyer when the auctioneer says 'sold.' As the recognized winning bidder, Buyer assumes full responsibility for his or her purchase. Buyer agrees that Manor & Street shall have no liability for loss, theft or damage of any type to purchase property, and that Manor & Street is not a bailee of said property. Buyer further agrees to hold harmless Manor & Street and all auction employees, agents or associates from any claims for personal injury and property loss or damage arising out of the sale transfer of property from Seller to Buyer. It is agreed that Manor & Street does not provide insurance coverage, or is an insurer of any property offered for sale at auction.

  10. In the event of any form of payment being dishonored for any reason (including but not limited to insufficient funds, or stop payment), Buyer agrees, regardless of whether said payment species is signed by Buyer as maker or endorser, that if the dishonored payment is placed in the hands of an attorney for collection, that Buyer agrees to pay all reasonable attorney's fees incurred, together with all court costs and other associated expenses.

  11. In the event that Buyer sues Manor & Street for any reason, and does not prevail, Buyer agrees to reimburse Manor & Street for all reasonable legal fees and expenses connected with the suit.

  12. Buyer agrees that all state and local taxes apply unless Buyer can provide documentation of tax exempt status including out of state residence, or a numbered resale tax certificate. Buyer also agrees to pay the Buyer's Premium and all other applicable fees.

  13. Jurisdiction/Venue-Governing Law: Guarantor acknowledges that Manor & Street is a Limited Liability Company of Washington State with its principle place of business in Yakima, Washington. All parties expressly agree that this contract shall be construed under the substantive laws of the state of Washington, and that the state courts of Washington shall have exclusive jurisdiction over any action brought to enforce the terms of this contract, or over any action arising out of the underlying transaction(s) with Manor & Street, and venue may be had in the Yakima County Court system of the state of Washington.
